KNOW YOUR RIGHTS

For those being targeted by ICE action.

Remain Silent

The 5th Amendment protects your right to remain silent.

When confronted by ICE, state the following: “I plead the 5th Amendment and choose to remain silent” . Once you invoke the 5th amendment, your silence cannot be construed as an admission guilt in court. The only thing you should ask for is a lawyer.

Document the Interaction

The 1st Amendment protects your right to document law enforcement action in public spaces.

Photograph, record, and take notes on the interaction as you feel comfortable. If ICE chooses to leave, it is recommended to seek legal defense and set up a care plan for dependents in case further action is taken.

Do Not Open Doors

The 4th Amendment protects individuals from unreasonable government searches and seizures.

ICE has no right to enter and/or search your property without a SIGNED Judicial Warrant. If they do have a signed Judicial Warrant, ensure that it is signed by a judge and has your name spelt correctly.

Do Not Sign Anything

Signing paperwork can have permanent and irreversible legal consequences.

If you feel you are being coerced into signing a document that you have not analyzed, cannot read, or do not understand, do not sign. Reiterate the following: “I am invoking my 4th Amendment right to remain silent and I request a lawyer.”
